Terms of Service

Welcome to Image Enhancer, owned and operated by Kawaii, Inc., an AI-powered photo editing application. These Terms of Service ("ToS") are a legal contract between you, the user, and Image Enhancer ("we", "us", or "our"), governing your use of the AI Photo Editor application and services.

By creating an account, downloading, installing, or using Image Enhancer, you agree to be bound by these ToS. If you do not agree to all terms and conditions, do not use Image Enhancer.

You must be at least 13 years of age to use Image Enhancer. Users under 18 must have permission from a parent or legal guardian.

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. Providing false contact information of any kind may result in the termination of your account.

Image Enhancer allows you to edit and generate images and videos based on text and image inputs using AI technology — including retouching, restoration, background editing, object removal, upscaling and photo animation. You agree to use Image Enhancer only for lawful purposes and in a way that does not infringe the rights of, restrict or inhibit anyone else's use and enjoyment of Image Enhancer.

You are solely responsible for the photos and text inputs you use to edit or generate images and any content you create, share, or display on or through Image Enhancer.

You must not use Image Enhancer to create, share, or display:

• Illegal or unlawful content.
• Infringing content that violates intellectual property rights.
• Content that is defamatory, obscene, pornographic, offensive, hateful, or promotes violence or harm.
• Content that violates privacy or publicity rights.

Image Enhancer reserves the right, but not the obligation, to review and remove or disable access to content that we determine, in our sole discretion, violates these ToS.

You are responsible for reviewing every edited image before you use or publish it, including confirming that photos used to sell or describe an item, property or service still accurately represent it after editing.

For any images or videos you generate using our services, you retain full ownership to the maximum extent permitted by law. However, there are a few caveats:

• Your ownership rights are limited by the terms of this Agreement.
• The rights of any third parties may also affect your ownership.

By using the Services, you grant to Image Enhancer, its successors, and assigns a perpetual, worldwide, non-exclusive, sublicensable, no-charge, royalty-free, irrevocable copyright license to use, copy, reproduce, process, adapt, modify, publish, transmit, prepare derivative works of, publicly display, publicly perform, sublicense, and/or distribute text prompts you input into the services, images you upload or otherwise input into the services (including photos provided to the editing tools), and images and videos produced by the service at your direction. You represent and warrant that you have all rights necessary to grant this license for any images you input. The license granted to Image Enhancer remains in effect even after termination of this Agreement by any party, for any reason.

Your use of Image Enhancer is also governed by our Privacy Policy, which explains how we collect, use, and disclose information that pertains to your privacy.

Image Enhancer and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the service.

Image Enhancer reserves the right to modify these ToS at any time. We will provide notice of any significant changes by posting the new ToS on the service.

Image Enhancer may terminate or suspend your access to the service immediately, without prior notice or liability, for any reason, including breach of these ToS.

These ToS shall be governed by the laws of the jurisdiction in which Image Enhancer is based, without regard to its conflict of law provisions.
